AskReplay LLC respects the intellectual property rights of others and expects its users to do the same. We respond to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (“DMCA”) and may, in appropriate circumstances and at our discretion, disable or remove content and terminate the accounts of users who are repeat infringers.
1. Reporting Alleged Infringement
If you believe content made available through the Service infringes your copyright, send a written notice to our Designated Agent (below) that includes:
- a physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
- identification of the copyrighted work claimed to have been infringed;
- identification of the material claimed to be infringing and information reasonably sufficient to let us locate it (such as the URL);
- your contact information (name, address, telephone number, and email);
- a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
- a statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act on the owner’s behalf.
2. Designated Agent
Notices of alleged infringement should be sent to:
- Designated Copyright Agent, AskReplay LLC
- Email: contact@ask-replay.com
3. Counter-Notification
If you believe your content was removed or disabled by mistake or misidentification, you may send a counter-notification to the Designated Agent that includes your signature, identification of the removed material and its prior location, a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification, your contact information, and consent to the jurisdiction of the appropriate federal court. We may restore the content unless the original complainant files a court action seeking to restrain the activity.
4. Repeat Infringers
We may, in appropriate circumstances, suspend or terminate accounts of users who are repeat infringers.
5. Misuse
Under the DMCA, knowingly making a material misrepresentation in a notice or counter-notification may subject you to liability for damages. Please ensure your submissions are accurate.
